Welcome to Rooted Health (“Rooted Health,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website located at www.rootedhealth.life and any related content, services, newsletters, or digital products we provide (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1) Eligibility & Accounts

You must be at least 18 years old—or the age of legal majority in your jurisdiction—to use the Services.
If you create an account or subscribe to emails, you’re responsible for keeping your login credentials secure and for all activity under your account.

Educational only. Content on Rooted Health is for general informational and educational purposes. It is not medical advice, diagnosis, or treatment, and does not create a doctor–patient relationship.

3) Content & Intellectual Property

All content, design, text, images, videos, logos, and trademarks on the Services are owned by us or our licensors and are protected by applicable copyright and trademark laws.
You may view, share links to, and print reasonable portions of content for personal, non-commercial use only, provided you keep all copyright and attribution notices intact.
You may not copy, reproduce, modify, translate, distribute, sell, or exploit the content for commercial purposes without our prior written consent.

4) User Content; Community Guidelines

If the Services allow comments, submissions, or uploads (“User Content”):

You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify (for formatting), and distribute it for operating, promoting, and improving the Services.
You are solely responsible for your User Content. You agree not to post anything that is unlawful, defamatory, obscene, misleading, infringing, invasive of privacy, promotional spam, or harmful to others.
We may remove or moderate User Content that violates these Terms or our policies, at our sole discretion.

5) Prohibited Uses

Use the Services for any unlawful purpose or to solicit others to perform or participate in unlawful acts.
Interfere with or circumvent security features; probe, scan, or test the vulnerability of our systems.
Scrape, harvest, or collect data (including personal data) without authorization.
Use bots or automated methods to access the Services without permission.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

6) Third-Party Links, Tools, and Affiliates

The Services may contain links to third-party websites, tools, or products. We are not responsible for their content, policies, or practices.
We may participate in affiliate programs (e.g., retailer or healthcare/wellness brands). If you click links and make purchases, we may earn a commission at no extra cost to you. We disclose affiliate relationships where required.
The Services may feature advertising (e.g., AdSense). Advertisers are responsible for their own claims.

7) Digital Products, Services & Payments (If Applicable)

We may offer digital products (e.g., guides) or services (e.g., consultations) for purchase.
Pricing & Taxes. Prices are listed in the checkout flow and may change at any time. Applicable taxes will be calculated at checkout.
Delivery. Digital products are typically delivered by email or download link. Services may require scheduling via a third-party booking system.
Refunds. Unless otherwise stated on the product/service page, digital products are generally non-refundable once delivered. For services, you may reschedule with at least 24 hours notice; missed appointments may be charged.
Payments are processed by third-party providers (e.g., Wix Payments, Stripe, PayPal). We do not store full payment card numbers on our servers.

8) Privacy

Your privacy matters. Our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully before using the Services.

9) No Warranties

The Services and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

10) Limitation of Liability

To the fullest extent permitted by law, in no event shall Rooted Health, its owners, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the greater of (a) the amount you paid, if any, for the product/service at issue in the 3 months preceding the claim, or (b) USD 50.

11) Indemnification

You agree to indemnify, defend, and hold harmless Rooted Health and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

12) Intellectual Property Complaints

If you believe content on the Services infringes your intellectual property, please email us with: (i) your contact details, (ii) a description/URL of the material, (iii) proof of ownership or authorization, and (iv) a statement made under penalty of perjury that your notice is accurate. We will review and respond in accordance with applicable law.

13) Governing Law & Dispute Resolution

These Terms and your use of the Services are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflicts of law principles.
You agree to the exclusive jurisdiction of the state and federal courts located in Kentucky, USA for any disputes that cannot be resolved informally.
Where permitted, you agree to attempt to resolve disputes through good-faith negotiations for at least 30 days before filing a claim.

14) Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will post the new Terms and update the “Last updated” date. Your continued use after changes indicates acceptance.

15) Termination

We may suspend or terminate access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. Upon termination, provisions that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability) will remain in effect.

16) International Use

You are responsible for compliance with all local laws when accessing the Services from outside the United States. We do not represent that the Services are appropriate or available in all jurisdictions.
